Terms of Service – Click & Steer

Click & Steer ("Click & Steer", "we", "our") is a product owned and operated by Sunny Vybz Corp. These Terms of Service ("Terms") govern access to and use of Click & Steer by renters ("Hirers") and participating garages/operators ("Operators"). By using the Platform, you agree to these Terms.

1. Key Definitions

  • Platform – The Click & Steer website/app and related services.
  • Operator / Garage – An independent business providing vehicles through the Platform.
  • Hirer – The individual renting a vehicle.
  • Agreement – The rental contract between a Hirer and an Operator, signed electronically.

2. Scope & Relationship

The Platform facilitates discovery, booking, identity verification, contracting, payment, compliance intake, and communication between Hirers and Operators.

  • Click & Steer is not a party to the rental Agreement unless explicitly stated.
  • Operators retain full responsibility for their vehicles, licensing, insurance, safety, and legal compliance.

3. Identity Verification & Document Capture

To reduce fraud and meet legal requirements, Operators (and approved service providers) may request:

  • Government-issued ID images
  • Driver's licence images
  • Selfie verification
  • OCR-extracted licence data
  • Manual document entry where automated capture fails

Completion or failure of verification may affect eligibility to rent.

4. Pricing, Fees & Payment

4.1 Prepaid-Only Platform

Click & Steer operates as a prepaid-only booking platform. All reservations must be paid in full at the time of booking to be confirmed.

Operators may not collect payment independently, accept cash or card on arrival, use their own merchant accounts, or bypass the Platform's payment system in any way.

Any attempt to circumvent Platform payment constitutes a breach of these Terms and may result in cancellation without refund.

4.2 Car Rental Levy (Government)

Barbados law requires a government levy currently set at BBD $5/day, capped at BBD $35. This levy appears separately at checkout, is not subject to VAT, and is remitted as required by law.

4.3 Platform Service Fee (Hirers)

A BBD $20 service fee is charged per booking. This fee supports Platform operations and becomes non-refundable once a booking is confirmed, except where:

  • The Operator cancels the booking, or
  • A duplicate or erroneous charge occurs.

4.4 Rental Amount

Rental rates, availability, and vehicle-specific rules are set by Operators. All rental payments must be made through Click & Steer only. Operators do not collect rental fees directly.

4.5 Taxes

Operators are responsible for their own tax compliance, including VAT registration when applicable. The statutory Car Rental Levy is non-VAT and is displayed separately.

4.6 Payment Processing

All payments made through Click & Steer are processed exclusively by the Platform's authorized payment partners. Click & Steer is the sole merchant of record for all prepaid reservations.

Click & Steer manages settlement, Operator payouts, and refund processing in accordance with payment processor timelines.

Operators are not authorized to collect payment, handle card data, issue refunds directly, or use their own merchant accounts for Platform-originated reservations.

5. Prepaid Reservation Policy (Pay Now Bookings)

This unified policy applies to all bookings made through the Platform. Operator-specific cancellation or refund terms do not apply.

5.1 Full Payment at Time of Booking

The total rental amount (including taxes, levies, and agreed charges) is charged immediately at checkout.

5.2 Card Requirements

The payment method used at booking:

  • Must be valid and presented at pickup
  • Must belong to the Hirer (unless legally exempted)
  • Will be used for any post-rental charges (fuel, cleaning, extensions, violations, damages, accessories, etc.)
  • Cannot be changed after booking confirmation

5.3 Booking Modifications

Modifications may be made up to 48 hours before pickup, subject to availability. A modification fee of BBD $30 (or equivalent in the currency displayed at checkout) applies.

If a modification results in a lower rental cost, no refund is issued for the difference.

5.4 Cancellation Policy

Cancellations follow these rules:

  • Rentals lasting 3 days or fewer → non-refundable
  • Rentals lasting more than 3 days →
    • The first three (3) days are non-refundable
    • Any remaining days are refunded

Refund timing follows payment processor settlement cycles.

5.5 No-Show Policy

If the Hirer does not collect the vehicle at the scheduled time: → The entire prepaid amount is forfeited.

6. Vehicle Condition, Use & Returns

Operators may specify rules relating to:

  • Fuel policy
  • Smoking policy
  • Mileage limits
  • Damage assessments
  • Cleaning fees
  • Extensions
  • Late return fees

Grace periods and fees are outlined in the rental Agreement. Fines, tolls, violations, damages, and other costs incurred during the rental remain the responsibility of the Hirer.

7. Cancellation & Refund Rules (Unified Policy)

Click & Steer maintains a single standardized cancellation and refund policy across the Platform.

  • All Operators agree to adopt and comply with the Click & Steer Prepaid Reservation Policy.
  • Operator-specific cancellation or refund rules do not apply.
  • Refunds, where applicable, are issued exclusively by Click & Steer, the merchant of record.

8. Disclaimers; Limitation of Liability

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law:

  • Click & Steer and its service providers are not liable for indirect, incidental, punitive, special, or consequential damages.
  • Total aggregate liability shall not exceed the greater of:
    • BBD $500, or
    • The Platform fees received by Click & Steer for the booking giving rise to the claim.

9. Governing Law & Disputes

These Terms are governed by the laws of Barbados. Courts in Barbados have exclusive jurisdiction unless otherwise required by law.

10. Changes to Terms

We may update these Terms periodically. Continued use of the Platform after updates constitutes acceptance of revised Terms.

12. Relationship to Rental Agreement

These Terms govern use of the Platform and do not replace the individual rental Agreement between the Hirer and the Operator. The Agreement governs the vehicle, its use, and all associated costs.
